How to ask for refund of advance paid

Can I get fefund adv paid in 2011 by signini/ng a 100/- stamp paper saying amt need not be given back if deed will not executed in 6 months
what is stated in the agreement is not clear from your query. Is it a proper agreement or not ? Who withdrawn from agreement etc.. are looked into first. If it is a proper agreement and terms are mutually agreed then it runs as per the agreement clauses, otherwise no.
