Friend trying to file false cheque bounce case. how to save myself

dear sir I have given a empty cheque to my friend against a hand loan, now iam require some more days for pay the amount to him, but he is not agreed with me for that and he says he is present the cheque with large scale of amount in the bank, but my account was insufficient funds now so iam sent a stop request of cheque to the bank by my online banking, if he present the cheque in the bank there are any legal issues against me, and we dont have any legal agreements between us just a hand loan, please tell me sir

HI,
sir your friend can misuse your blank cheque and he can file case against you u/s 138 of N.I.act. issuance of cheque is sufficient to constitute case u/s 138 of N.I. ACT. he can adduce oral evidence against you.
but in your case you can create some defense evidence. first you issue a legal notice to your friend not to misuse the cheque and clearly specify the actual amount due to him.
and request him for some time for total repayment of the debt. this step will work against you also to the extent of the money you actually indebted to your friend. but this step will stop your friend from filing a false case against you.
