Can brother claim 50% share in mother's FD when I am the nominee

20-Mar-2023 (In Banking / Finance Law)
We are 2 brothers. My mom staying with me. She has some fixed deposits in bank. She nominated me. Recently she was admitted to hospital. I incurred medical expenses around 2 lakh through my atm. Subsequently she died in hospital. My brother is claiming his share in the FDs on 50:50 basis, without considering medical treatment expenses incurred by me the nominee . What is the legal view.

Hi, You need send legal notice to bank claiming the FD as your the nominee. You need file a affidavit of nominee details. Once after all the documents submitted to bank then bank would transfer FD to your name. For better legal advice, you can discuss with me along with FD details and the death certificate of your mom.
