Amount detected from the bank but bank returned cheque

Dear sir , I issued a cheque to House Owner towards Rent , The Cheque is cleared in my Account , and The Bank Amount debited in my Account . But my House Returned the cheque due to funds Insufficient.Now can i take any legal Auction on Bank .Pl Advise me.

As per RBI Guidelines to Banks “Wrongful dishonour of cheques due to the negligence or mistake on the part of the bank has been held to amount deficiency in service. Dishonour of DDs due to the lapse or omission on the part of the officials of the bank like non-affixation of signatures, failure to mention code number etc. have also been held to be amounting to deficiency in service” you can file a complaint in consumer forum for damages.
