TS promotion to Lt Col in 20 years as per VI CPC –benefits awaited.

Supreme Court , recently ( IA No. 1/2016 IN C A D 5112/2016) dismissed UOI appeal against AFT (PB) Delhi , OA 138/2013, implies that all Major/Lt Cdr/Sqn Ldr with more than 20 yrs but less than 21 years and retired/ PMR in period 1 Jan 1996 and 14 Jan2000 are to be granted Lt Col/Cdr/Wg Cdr rank and pension. I took PMR in Aug 99 with 20 y ,2.5m service, getting pension of Major. Am I entitled to the rank of Lt Col and pension ? Which office should I approach and what docs to be attached?

Hi Sir, You are entitled to the pension of Lt Col.
All major and equivalent are entitle to the Pension of Lt Col in 20 years of service if they are retired after 01.01.1996 and in case they are retired prior to 01.01.1996 they should have 21 years of service. Since you retired after 01.01.1996 and you have more than 20 years of service you are eligible for this. You may approach service headquarter along with your testimonials and detailed representation. Your case is covered by OA 138/2013, wherein the Hon'ble AFT called the orders As benevolent legislation and allowed such benefits. The appeal in the matt3r was dismissed by Hon,'ble Supreme Court. However, As seen in earlier cases of Disability pension etc the MoD remains in a state of denial and allows benefits to three appellants in that case.
You are advised to send a representation to your pension sanctioning authority , Dte of Army Veterans detailing your case.
By experience I can say your case would be rejected. You may then challenge the order in AFT.
