Time limit for filing Statutory complaint and appeal in AFT

Dear Sir, What is the time limit for filing a Statutory complaint against the decision of Departmental Permanent Commission Board for Short service Commissioned officers in Army. and is there a time frame for filing appeal in AFT as well. Because i dont expect much from the inhouse stat complaint which are generally kept pending for long durations on one pretext or the other. pl shed some light.

Hello, It is better to file stat as soon as possible however time limit is not specified but it is to be filed before next board is constituted. The stat is to be disposed off within 90 days but it never happens. However you can approach AFT after 90 days. AFT rules also says to wait for six months before approaching AFT but that is upper limit. You can file your stat asap and if it is not in favour or not disposed off you can approach AFT. It is also advisable to consult lawyer before filing stat to strengthen your case. With best wishes

You must file a stat complaint within 30 days of feeling aggreived by an order. It may be delayed with substantive explanation. Thereafter you will have to wait for six months within which your compalint has to be decided but you may move to AFT. Within six month of an order you have to file application before AFT.
