Posting to field area despite being Permanent Low Medical Category

Dear Sir/ Madam I am serving in Army and currently posted to a highly active field area in NE India. I sustained severe knee injury in May 2015 because of which I was downgraded to Permanent Low Medical Category in Jul 2016. My employment restrictions included being unfit to serve in extreme cold/ hot climate areas, fit only for sedentary duties and unfit to ride/ drive vehicles. My recent medical review board indicates deterioration of the injury. I had requested for posting to any station where appropriate medical fecilites were available for future injury management . Despite this I have received my posting order to move to J&K by 31 Jan 17. I requested to reconsider my posting on medical grounds but was turned down by authorities. Please guide if I can seek legal redressal on this subject.

You cannot be posted to Fd Area if restrictions have been palced by medical board. You will have to challange the order in the court. As it is a matter of posting/transfer you will have to approach the High Court. You may call and take free legal advise.

Hi if you are in low medical category and your injury is caused by service you are entitled to take treatment and get posted where medical fecilities are available. If you have already requested in writing make it a stat application or you can consult lawyer to seek appropriate legal recourse. All the best
