How to secure my job? Claimed age relaxation as per notification only.

23-Aug-2023 (In Armed Forces Tribunal Law)
I served more than 6 years and discharged in 2007. Then I got the job in AP state police department in 2012. Being a Non Ex-servicemen I claimed age relaxation which i rendered service in army as per notification only and got the job. My probation also declared in 2014. Now department saying, you produced Non Ex-servicemen certificate and got the job in Ex-servicemen quota. What to do in this situation? 1. Am I eligible for age relaxation or not? 2. Is there any provision, If suitable Ex-servicemen is not available, that post will be allotted to Non Ex-servicemen? 3. How to secure my job?

You were entitled for age relaxation and you availed the same.
However, you were not entitled to ex servicemen status. In case you applied against ex servicemen quota by misrepresentation of fact you can be proceeded against for wilfully concealing facts.
If you applied for general quota seat but your department inadvertantly treated you against ex servicemen quota then they can not act against you. If they do so, their decision can be challenged in Court.

If you have disclosed fairly in your application for the post there is no need to worry. If you have applied as per the terms of advertisement than also don't worry but the disclosure must be fair. The Govt of India policy 12 Dec 1979, revised in 1986 and now again revised on 4 Oct 2012 is the policy for relaxation of age and reservation for ex-serviceman. Since you are not an ex-serviceman being completed only six years you have to go through these policy letters. But if you have been discharged from service on medical grounds than you should be treated as ex-serviceman.
