JV Agreement Flats NOT handed over

Delay in Handing over flat for 2 years Builder cheated. There is a clause of arbitration. What are my options here, should i get into arbitration or file a case in the consumer court

HI,
First of all, are you the landlord? Is the JV with the builder and what are the terms of that agreement. If there is a arbitration clause, then very much you can invoke it . Also, you can file a complaint against the builder under consumer protection act for deficiency of service .

Arbitrtion is less time consuming but more costlier. If the intention is to invoke arbitration, then, before starting arbitration process, you can seek interim remedy from the High Court /Dist Court. The matter is likely to get settled there itself. It is expeditious and relatively cheap.
