Can a regular suit be filed after withdrawing pre litigation case

I have filed pre litigation case in district legal services authority. but they are not taking any action on the defendent, because he is not attending in PLC case i want to file this case in regular court. so what is the procedure to withdraw my PLC case from district legal services authority. and after withdrawing the case can i file the case in regular court or not?

Subject to review of your papers, my advice is as follows:
You can file a regular case even without withdrawing the dist legal service authority and in the suit that will be filed, you can state that things didn't work out in the pre litigation stage and hence you are filing the suit.

It is first to be seen as to what you have filed, I mean the subject mater of your case. If the defendant is to attending the matter you should first find out with the DLSA as to what is the reason they have got from the processor, as to why the defendant has failed to turn up. I would first like to know the issue.
