Whether an award of Facilitation Council under MSMED Act can be impounded if not stamped as per Section 34 of stamp act, in view of the objects and reasons of MSMED Act and vested legal rights conferred upon small scale enterprise to get due amount against supplies and section 24 provides overriding effect over other law. Moreover, the award passed by facilitation council is having force of decree and is not an instrument under article 12 of Bombay Stamp Act. My question :- a) Whether any judgement either of High Court or Supreme Court is so far made in that respect and what !

I was unable to find any case law on the point of whether stamp duty is required to be paid on an award passed by the facilitation council under the MSMED Act.
