Married in the christian (Catholic) in 1980. I work abroad since then. We had 2 children. I found out that he was having an affair with another woman back home in India in 1990, that was the last time I saw him. I am abroad up to now, already 63 years old. I want to be free, need a divorce, can you help me in filing the divorce documents and represent me in the government offices with all the procedures required?

If you both are ready for divorce you can file divorce by Mutual Consent or if he is not ready for divorce you can file divorce on the ground of mental and physical cruelty or you can file divorce on the ground of adultery.

You can file for maintenance application for you and your child U/Section 125 of Criminal Procedure Code in the appropriate Court and serve the notice to your husband through the Court. After getting the order of maintenance only you proceed for divorce by making Talaqnama/ Mubaratnama as required by the Court.



Q: How to file case against builder for not giving possession of property

We residence in Adarsh Nagar Delhi. We purchased a flat from builder. After selling all flats builder is not giving us the servent room, which is in Parking. He is also not giving us original sale deed. We are facing one more issue with the flat which is bad or 3rd class matirial used in flat construction.

The Builder has to abide the terms and conditions of the Agreement. If he is not abiding the terms and conditions you can lodge the complaint with the Police and you can file the Complaint the The Consumer Forum under Consumer Protection Act.



Q: How to file a suit against a person for recovery of money

i had deal with a person , he just gave me 50% amount and he said remaining amount he will not give. there was no bond or agreement between us , it was oral face-to face deal. how can i take money from him legally?

Without documentary evidence it is difficult to prove that he has taken money from you. Circumstantial evidence such as in that period some transaction has been made or some deals are made by him. If that you can prove , you can give him Legal Notice and have to give some time to him and then you can file summery suit for that.



Q: How can I save my marriage without taking legal recourse

I was married in Dec 2015 and I am currently 6 months pregnant. My husband quit his job just before marriage since he was working in another city and did not look for a job after that. I am working and have been taking care of all the expenses. He has been violent, extremely abusive, suspicious and also was having flings with females. We had a fight in November and he left the house after that and did not return. He blocked my calls, his family said they are not aware of his whereabouts. You do not want to end the relationship so You can file the Petition for Restitution of Conjugal Rights U/Section 9 of the Hindu Marriage Act 1955 from the Family Court. For issue notice you can give the last resided together address to the Court. If your husband did not get the notice you can get the order from the Court for issue Public Notice after producing the the missing Complaint. In this case your rights as a wife are protected and from the Hon'ble Court your matter will be settled.
