Q: Need guidance on how to get the property registered.

My Grandfather purchased a property in 1992 on power of attorney in Delhi, the person who sold the property has died, my grandfather also died in 2006. My Father has a GPA of that property issued by the owner of the plot, the property is free hold and the mutation has been done long back, all property tax has been paid till date, my grandfather have 4 children's out of which two died in last 4 years, one is citizen of some other country, my question is that what I need to do to convert the property on my father name, all of my father siblings are ready to provide NOC if required, the only condition is they need there share in the property once we will sell it, but to sell I need to convert the property on someone name in my family, how can I do that? Please suggest.

you have to approach the competent court to get a succession certificate first. Aftrer getting the Succession certificate you may approach the registrar to get the property registered under your name.



Q: Separation agreement before going ahead for divorce.

We are not divorced yet and separated through an agreement, where in we decided that I move out of our joint property and she continue staying in the same house along with our daughter till she turns major. We also agreed on certain expenses and the EMI’s to be paid by me till we decide to sell the house. My question is , how can I prevent my mother in law to stay in that house whom I believe is the main culprit from the day one of our marriage, Can she file false cases against me in case I try to remove her mother from our house? What would be the best way to get a mutual divorce under Islamic law?Also, What is the credibility of separation agreement in law ? This agreement was made by her lawyer , obviously with almost all the points in her favour.Thanks
