Q: Builder delaying completion of flat for possession

builder  took advance in April 2006 for handing over constructed flat by October 2008 but did not even start and then assured in writing to hand over by 31.03.2012 while admitting receipt of 95% costs till November 2011. But, even after 11 years, the flat has not been completed for offering possession to the investor builder  has been maintaining complete silence since 2012 ?

You can take him to consumer court or file a FIR. You have mentioned builder took advance in April 2006 for handing over constructed flat by October 2008 but did not even start and then assured in writing to hand over by 31.03.2012 while admitting receipt of 95% costs till November 2011. You have not mentioned when was the last part payment made by you.But, even after 11 years, the flat has not been completed for offering possession to the investor builder has been maintaining complete silence since 2012 ?You need to show all correspondence to a lawyer to examine and give a more accurate advise.



Q: Court fees and estimated expense for case filing u/s 138

Could you please let me know - know how much court fees and other estimated legal cost I could incur if I file a case under section 138 of NI Act at Saket Court, Delhi to recover money of Rs. 50,500 against which cheque was issued by the defaulter/Issuer/Drawer.

There is no court fees for filing in Delhi. The legal cost would be 10 % of total amount recovered. so for Rs. 50,500 cheque assuming the court agrees to award Rs. 1,00,000/- ( as per law you are entitled to upto twice the cheque value and otherside is liable to be put in jail for upto 2 years) you would incur Rs. 10,000/- and your total earnings would be Rs. 90,000/- out of a case which may realistically last from a year to 3 years maximum.



Q: Father threatening me how to take legal action

My father doesn't want me to colour my hair but i love to colour it. If i don't obey him, he threatens me that he'll shave my head and sometimes it goes to life threatening. So do i have any right in the situation? I'm 16

However if one party has incurred sole expenses towards the engagement then they may try to recover the same by alleging that the same was broken due to a dowry demand being unfulfilled.
