usually when there is a loan on house property lender Bank registers a mortgage over it which reflects in records and such property cannot be transferred to other's name. And even if it is transferred the lein of lender bank over it continues. The aggrieved person can get the transfer cancelled if proper grounds are made out.

You may have received Case file and notice from thigh Court. The case file will include the petition file by your husband. you can go and represent yourself on the hearing date in High Court and oppose the petition by showing the proof. but first you have to file in writing what is called objection to the case. you can take over assistance to prepare objection.

We signed an MOU with a firm to buy a property and gave Rs 1lakh as a token/agreement amount while signing the MOU.In this MOU, it is mentioned that the refund will be issued in case of loan is denied against the property.The bank has rejected the loan due to unavailability of documents and we have provided the bank rejection letter to the company. Now they are not returning the money stating that we are cancelling due to personal reasons and we should try another banks.What can we do in this
