Q: Wife and Family Is filing a divorce petition

Sir, my wife and their family is filing a divorce case and they are saying that I am physically torturing and pledged golds given by her family. I didn't torture but the fact is I pledged her gold for starting a restaurant. I deeply love her and I am not willing for divorce and I can't live without her. What to do sir?

Hello.... From your query I can feel how much you concern about your wife. If you are not willing for divorce, court cannot force her to do so. And at the same time, if you really wish her to back to your life you can file that petition before the same court where she filed divorce petition. So good luck. Q: Getting the dowry we have given for the marriage

My his says he needs divorce, but he won't return my ornaments unless I sign for the mutual divorce.how can I get it back. I'm a hindu.

Hello.... Your husband and you can file a joint divorce petition before the Family court if both of you are willing...But for you, it would be better you can file an Original Petition before the family court for return of gold ornaments. Q: Husband Went Missing And Not Taking Care Of Wife Nd Kid

Hi, Am working in private sector. My husband was in dubai and he came to kerala on nov 3rd 2019, but from his office i came to know that he came to india on oct 10th. Once he came to kerala, he went missing/went to mumbai on dec21st after informing others that he dnt wish to continue relation wiith me. Now a days he used to call his mom via whatsapp for not providing his contact number and not calling or taking care of his kid and myself. My baby is 5year old girl baby..... When we enquired in mumbai we came to knw he was with his girl friend in october and stayed there... now i want to know how i can proceed against him legally?Do i need to file a missing case to know about my husband? Is my kid eligible for child maintenance from him and his property? He is a single son for his parents. We belong to hindu religion. I.. i need to know how i need to proceed against my husband

Yes... You can file a Maintenance case against your husband before the family court. Your child is eligible to get the maintenance from her father. File an MC petition at the earliest.. So that he will appear before the court and you will get the chance for mediation.

For filing mutual divorce.. husband and wife need separation in two different places ?for getting divorce .

Hello.... For getting mutual divorce separation is needed... however it is not said that both husband and wife have not to be lived in the same place. Both of you can approach a lawyer and you can file a petition before the Family court.

Q: Hindu Ancestral property registration doubt

Hi Sir, I am a lady who is 30 years old and married living with husband and 5 year old kid. My mother wants a help from me to save our house from debt. She needs 5 lakhs to release the documents from the bank. The property is 15 cents and a house. This property is my grand fathers( mother's father) property given to my mother while partition and was registered in both my mothers and fathers name. My father passed away in 2015.I have an irresponsible elder brother who has not been working or trying to clear the debt for nearly 5 years. We have given him lakhs multiple times but everything was in loss. To be on the safer side this time, I told my mother to register the property in my name after clearing the debt and getting the documents from the bank. Now my mother and brother are ok to this. However, they may change their mind and claim for the property later. We seek your advice on how to register this property in my name completely so that nobody can claim it later

Ok... you can get it registered on your name. For avoiding other legal complications in future you can make it as the Sale Deed in stead of Gift Deed. So that nobody can claim the property in future.
