Q: Customer filed false consumer case on demanding due payment from him.

Dear sir, I have delivered some machinery to my customer. He has not made full payment. I send some letter for the money and the last letter which I have send and mentioned that I am going to take legal action against him. After receiving my letter he has file a case against me in consumer forum and claimed the machine is second hand and not working and also give the money back which he has given for the half amount if the machinery.. The machine which I have given is brand new. I understood that consumer court is always supports customer. How can I get the justice. Please help me Thank you

Consumer courts go on maerits of the case. If you are not at fault nothing will happen. Only u just need to defend yourself well. Show all the evidences on affidavits and present your case in the best possible way

Q: Purchased a scooty with faulty parts needs to replace that scooty

i sir i am reside in Mumbai on 14/03/2017 i have purchased tvs Jupiter from day 1 i am facing issue with this scooty like low mileage and fuel indicator is faulty service center already changed my meter and fuel gauge but problem is still on its been 8 month and service center keeps telling me that original parts are not available from tvs and they keep delaying me so i wanted to ask you is am legally eligible to replace my scooty with new from delar???

yes you are legally eligible to get a replace or refund of the entire scooter amount. also you will get additional money for all the troubles and hassles you have undergone. we will have to approach the court.

Q: Procedure to get money back from the builder

We had booked a flat on Feb 2017.Builder had promised to launch the flat on June 2017 and start construction. But builder till date has not even launched the flat not even started construction, he is not even having environmental clearance for the flat. Can we get back the money what we paid from the builder?

Definately .. all the documents will need to be there and we will have to forward a letter to the builder describing all our grievances. Also which builder is this. We will need to ascertain whats the best in the situation

Q: Harassed by make my trip, what to do

We booked roind way flight ticketsfrom Mumbai to prague.. It was clearly mentioned that the tickets were refundable and flexible before departure. About 8 hours before the return journey I tried to cancel them and get one for the next day but they wouldn't let me. They said I could do that and pay the difference between the tickets which was greater than the cost of fresh tickets at their website at that momeny. After being on call with them for 6 hours we were stranded in another country and had to buy fresh tickets to come back. I'm the following five months I contacted them thousands of times on calls, emails even tweets with no proper response. They eventually said the airline would give an amount of approx 10,500 where as the tickets coated 50,000+. I sent my consent for the refund. And now they charge me 10,233 as their own penalty and are giving me back only 227 rs. I did file a case with the consumer forum online with no proper response.

We will have to approach the consumer courts and file a complaint before the consumer court giving out details of our grienvances and the remedies that we are looking for.consumer courts are very lienient and uually reliefs are given within a short span of time. Also the amount of compensation will also be good considering the facts and legal issues in our case

Q: Can legal action be taken in case possession given without OC

I got possession of flat 3 years back but builder has not yet provided occupation certificate and municipal water supply. Can you let us know what action we can take against builder.

yes definately action has to be taken for not providing water and OC. kindly approach courts for seeking redressal of the grievance, also you will need to show all documents. also proof of possession is necessary
