We have property dispute with our neighbour. He has filed a case in SDM kapashera court. We have received a notice from SDM court kapashera stating 151 of CPC, the date of hearing and my name vs my neighbours name but his lawyer or counsellor name is not given. Should we hire a lawyer immediately or first appear in person before court?

I suggest that you please send a scanned copy of the notice you have received. Also check if the notices states you have to appear in person or by a pleader or either. In any case it is suggested that you send a copy of the notice and then we can see what needs to be done.

Q: Want to the amount of bail bond to be submitted to the court of law?

My wife has filed 498a case in the court I want to know if I apply for anticipatory bail, do I have to sign a bond if yes what is the amount of bond do I have to submit in the court. Also want to know what will be the total fee for file anticipatory bail and bond

Given the circumstances as stated by you it is advisable that we shall file for an anticipatory bail. Also be informed that the bond amount is a matter of court discretion but more or less is around Rs. 5,000/-. Take note that the amount is not to be deposited in court as such but only acts as security. The fee for applying for bail depends on case to case after considering the background of case and previous conduct of the person applying for it. You are advised to contact for conclusive opinion and further pursuance of matter.



Q: Builder not returning amount paid to him for booking

I had paid 3 lakh to a builder/colonizer as an advance for a society plot in Noida, but somehow he did not get the possession of that plot. He gave us post dated cheques to return our money but then he started requesting us not to put cheque in bank as he will pay us cash. He has never denied to pay money, but never paid also. I last received his message on January 29th that he is in Bombay and will call us once he is back. Now he has switched his phone. The Cheque he gave is of July 7, 2014 date. Please advise what legal action can be taken against him and how can I get my money back.
