Q: Procedure to get property divided when one person is abroad
My father had 3/4 acre land with value of 5 crore in kerala. He has 3 sons ( including me), one daughter and my mother. Other than one son, all are wanted to get partition this property, but one son ( eldest one), he is staying in abroad doesn't wanted to get partition now. All property belongs to the name of my father, he expired 15 years back. What is the solution to get resolved legally without the presence of one son? Please advise

Hi,In this Case, every individual has the right to get the undivided property get partitioned in their name if they have a right in that property. If other parties willing, all parties can execute a partition deed and get it registered. If any of the persons are not willing to get it partitioned, in order to effect the partition of the property, you can file a Civil case for partition of the property in the Munsiff court or Sub Court, as per the appropriate jurisdiction. Q: What to do if the case is pending since four years
I have filed one civil case in the munisif court and the court has issued ORDER favour to me. The case is that one person has taken land sand from my land for Rs.50000. I have received the agreement deed from the opposite person. But he didn;t pay the amount. Now 4 years are gone. Still the case is pending due to impossibility to issue warrant to that person. Aournd 8 items the warrant has been issued. But the Ameen whent to the home of him and he is not able to issue the same due to the absence of the criminal. Let me know the next procedure to receive the amount. The oposite person has no land or any other property in his own name.

Hi,In this case, the better option before you is to file a Criminal complaint against that person for the offense of cheating. Q: Correction in SSLC documents, passport & marriage certificate
Date of birth and place of birth in my SSLC(Kerala) book and passport and date of birth in my marriage certificate is different than my date of birth certificate. My SSLC certificate is issued in 1995, the passport is reissued in 2014(first issued in 2004) and the marriage certificate issued in 2009. Currently, I am working in gulf country and would like to migrate to another country. I would like to know the procedure and time frame to do the corrections in SSLC book, passport and marriage certificate. Also, I would like to know is there any agency who can help me to get all these done as I am living outside the country.
