Q: issue of maintenance under section 125 crpc
if husband is getting insolvent degree from court then can he get rid from under ipc 125 section. .or plz informed whats ground will be getting rid from under ipc 125 when wife putup case for maintenance and she stay live without her husband ??
Advocate Shaikh Pappu Kamruddin answered
As per Sec.- 125 of Cr.P.C. (1) court may upon such neglect or refusal pass the order against her husband to make a monthly allowance for the maintenance of his wife or child.(2) Any such allowance for the maintenance or interim maintenance & expenses for proceeding shall be payable from the date of the order passed by court.(3) If husband not pay or give maintenance amount to her or if he fail to pay without sufficient reason to comply with the order. Court may for every breach of the order issue a "Warrant" for levying the amount due in the manner provided for levying fines, remaining unpaid after the execution of such Warrant to imprisonment for a term which may extend to 1 month or until payment if sooner made.Amount of maintenance can be recovered from his property or his parents also on whom husband dependent.wife also live without her husband such Court may consider reasons or grounds of refusal stated by heralso file case on husband by "Protection of Women from Domestic Violence Act..2005" u/sec.-12,17,18,19,20,21,22,23.for Justice, interim order, and for maintenance.
