Questions Answered by Advocate Sanjeev Sharma

Q: two sale deeds of same property

i purchased a flat in punjab, got registeration of property also. later after 2 year i came to know that the seller had earlier sale deed with some other person also. and the second party had filed a case in court against him. What should i do now, as there is stay order on selling the property on my property mutation.

Advocate Sanjeev Sharma answered
D/Sir,The caveat emptor principle applicable i.e buyer beware. You should have enquired about title of seller. Case of cheating made out. Lodge FIR, and also file suit for recovery and in recovery too, you will be hopefully getting price mentioned in sale deed not market price

Q: Karta is alive and not ready to give property to daughter

If the karta is still alive and given the property to their son as they don't want to give the property to his daughter . So whether daughter can stop the registration of property and get a share or not ?

Advocate Sanjeev Sharma answered
D/Sir,If the property is Kanta's self acquired property daughter can't stop registration. If property is inherited one definitely she can interfere in registration process. If Kanta is alive the mode of transfer of property is not mentioned...Gift or sale deed
