Questions Answered by Advocate Sanjay J Rajpurohit

Q: 2 feet is occupied on our empty land from past 20 years

Dear Sir/Mam, We have an empty land in chennai of length 40feet and breadth 60feet. For 20years it is an empty land but we pay land tax regularly. But while just measuring our land it seems that our neighbour is occupied 2feet (2*40feetlength=80sqft). What can we do now. If we move legally how long it will take to get judgement and how much we need to spend. Kindly advice please

Advocate Sanjay J Rajpurohit answered
1year minimum it will take by that time before hand u can get injuction and get the land in ur hand and it will cost you around 30000 at least over all which u can claim from the party who has illegally taken the land once u win the case

Q: false case and cheating by person selling us land

I have brought a land on 2013 January ,the person from whom i got the land made an agreement that i should pay him the remaining partial balance within 7 days from the registration date and the final within two months after he clear the ground and show us the boundary of the land as per the agreed measurement. as per the agreement we requested him to return the signed agreement and take his money on 10th of January 2013, but he said us that he missed the agreement paper and told us to deposit the money in his account. we informed him unless he returns the agreement paper we will not pay him, and on 19th January 2013 he said that he will bring the agreement paper. by 11:30AM he came and said us to show the money only then he will return the agreement. on seeing the money he grabbed it and ran away without submitting the original agreement. now he has filed a case against us that we haven paid him any money, and we should pay him the money with 24% interest for the past three years.

Advocate Sanjay J Rajpurohit answered
What he did is a crime u can eventually go for a criminal case against him rarther than thinkin on it you go the local police station and file complaint on him. And if u want to get that property depending upon the value file a suit to specific relief act to perform the act
