Questions Answered by Advocate Sandeep Kumar Bawa

Q: TO KNOW ABOUT MARRIAGE AGGRIMENT BEFORE MARRIAGE

IF SOME PARTIES DID AGGREMENT BEFORE MARRIAGE THAT THEY DO NOT RECEIVE ANY GIFTS FROM THE OTHER PARTY. IS THIS VALID ? ? OR LEGAL ???? IN HINDU MARRIAGE ACT.

Advocate Sandeep Kumar Bawa answered
validity or non validity does not mean, because if you make agreement before marriage, it does not mean that you did not demand dowry after marriage. demand of dowry and non receiving dowry, both are separate things.

Q: Cheque Case Have To File In Ludhiana Court

Cheque bounce as stop payment, now wants to file case, what is limitations of further procedure about that

Advocate Sandeep Kumar Bawa answered
first of all you will have to issue a legal notice within 30 days from the date of memo and if payment is not disbursed within 15 days after issuing legal notice then you will have to file complaint under section 139 NI Act within 30 days.

Q: Cancellation of complaint made in NCW

I have submitted a complaint against someone for mental harrashment in NCW which has been forwarded to SSP mohali for further action. But now i want to withdraw it as it has been resolved mutually. I have emailed to NCW as well as SSP mohali. Is this enough to get a complaint cancelled?? I don't want police to take any action. Please suggest me what to do?

Advocate Sandeep Kumar Bawa answered
only email is not enough, rather you will have to approach ssp mohali and record your statement of withdrawal the complaint, otherwise it will remain pending against that very person, and you will be called by police.

Q: my husband filed case of sec 9 nd i filed case ofdomestic violence

can my husband go abroad if i put domestic v case against huby and mother and father in law? i belongs hindu culture. if he can go what should i do so that he cant go

Advocate Sandeep Kumar Bawa answered
he can go abroad, because personal appearance in court on each and every date is not required, but you should move application in court to this very extent, moreover you should file complaint before police for 406, 498A IPC.

Q: My parents didn’t want me as their child want to case against them

Can i case against my parents as they do daily torture to me & and give threat that they will out me from house .they didn’t spend 1 minute with me ,they daily say abuse words to me they say that they didn’t want me as their child.

Advocate Sandeep Kumar Bawa answered
if you are major then you can not file any case against your parents. rather they can file case against you to throw you out from their house, so deal them with love, otherwise you can only make complaint against your parents before police, but even then no useful purpose will be served.
