Q: Father paid bills of grandfathers property now others asking share

We have a house on my grand father's name but all taxes like house, corporation, water, etc were paid by my father for more than 30 years. My father has 9 siblings(5 brothers and 4 sisters) all married and have grand children. None of the siblings have shared the responsibility to pay the taxes or property maintenance all these years. My father had spent all his savings on this property and has the documents as well. But today all my uncles, aunts and cousins are quarelling for a share. His health is not well recently. What should me and my sister do to get the property legally?

Advocate Ravinder Pasula answered
By paying taxes, you will not get right. At the most you can recover the money you spent legally from the other siblings. If you want to get the share of your father, you father has to gift the same to you or your siblings as per his wish. You have not mentioned that how did your grandfather got the property, by self earnings or from his father. If the property is ancestral, then you and your siblings have legal right. Otherwise, the authority will be in the hands of your GF.

Q: Land given by AP government is disputed, villagers are troubling us

When SRSP irrigation project was constructed my mother lost land as the village was submerged and the then ap government compensated my mother with disputed deforestation land. From those days to till date the surrounding villagers are opposing us from using it and selling. The district collector tried to convince the villagers but failed. Please suggest legal advice what we need to do as this is almost 50 years unresolved problem.

Advocate Ravinder Pasula answered
File a civil suit against the persons who are disturbing you and objection injunction order against them. Then take Police protection to enter your land and construct one room, compound wall, gate, take electricity connection, water connection, landline telephone connection etc to establish you are in possession. Your case is complicated, but solvable. Contact me through Lawrato.

Q: Rights over the property in case different name mentioned in records

I have land 2 acres it's came from my grandfather's. 1954 to till now we are cultivating that land. In revenue records pahani 1954 to till now my grandfather name is there. But 1974year 38-E issued some other person. Now my doubt is who as more rights on land ..

Advocate Ravinder Pasula answered
The other persons will have right. Because from 1974 when the other persons name appeared, you have not taken any steps nor challenged the other person's right. Hence, even assuming that he is not legal title holder, he got title by adverse possession. It is too late to fight against him. Anyway you chances to win the battle, if you pursue the case carefully. Contact me through Lawrato.

Q: Mother wants to sell her property to outsider without child's consent

If a mother is a absolute owner of the property. Can she sell her property to the out sider. Without the presence of her childrens at the time of transfer of the property. Or registration

Advocate Ravinder Pasula answered
You have not mentioned what is your religion. Assuming that you are Hindu, the mother can sell the property without the presence of her children at the time of Transfer of property. The property lying in the name of female is exclusive property. Nobody can claim the same.
