Q: Builder wants to construct 4th floor after 4 years of posession

We have building with 3 floors with 4 flats on each floor. Now after 4 years posession of each flats, builder wants to construct 4th floor. He is having permission of municipal corporation. Problem is that he has sold entire land to all flat holders of 1st, 2nd and 3rd floors. He has no land remaining for 4th floor holders. Can he still build 4th floor n sell flats?? We have already parking issue in our society. Also there is risk if he constructs new floor as we all stay here.

Dear Client, Builder has right to construction of this building for extension of Flat, but construction start after permission of municipal / corporation, and builder is not permission so no construction of flat of extension.

Q: Bank auctioned builders entire project to new builder except my flat

I Booked one flat in June 2013 and paid booking amount. In Sept 2013, builder take mortgage loan against project excluding my flat as it was booked by me but builder mortgage whole land without my knowledge. Builder was defaulter and bank auction project to new builder with whole land but without my flat. Now what will be my situation as my flat is without undivided land.
