Q: Conditions for waiver of 6 months period in mutual divorce case

what are the condition for waiver of 6 month period as supreme court allowed. I have heard that the waiver only can be passed by high court and supreme court. my divorce case is running in tis hazari court-mutual divorce. if i go for waiver for 6 month cool off period, will it be approved by tis hazari court or not? Please reply

Yes it's approved by same court where your first motion filed ,if your date of separation is above 18 months you will file application for waiver off time.in the same court some legal para is also mentioned in the application



Q: Gave custody to wife, but child wants to stay with me, what to do ?

Hi, We have file mutual divorce on August month and with agreement I have given my baby custody to my wife. But now my baby want stay with me. Our 2nd motion not complete yet. What should I do.. Kindly suggest for the same.

hikindly discuss your matter with lawyers and opposite counsel ,what is the age of your kids in custody case judge are see the betterment of child or after file second motion you file custody of child or if want mention in second motion draft as child visiting right or custody of child .



Q: Wedding planner not refunding the amount given for wedding

We booked a marriage hall for our wedding function through an online portal . We already paid approx 1.5 lakhs in advance. Wedding is scheduled next month.but Venue is sealed by GDA because it was on illegal grabbed land. The co. Through which we booked are not refunding our money. Rather shifting to other locations which are not of our choice. What should we do

Hi as you writ in your query first you send the legal notice of recovery on latter head of any lawyers and then the amount i think your money will refund by marriage organizer or if they will not return your money you will file a case of recovery suit.



Q: Money lent to a friend through paytm not returned.

I lent 18000 to a friend by paytm after recharging it through my credit card. He promised to return it by 15 August which is due date of my credit card payment. He didn't pay on that date and after giving 2 more deadlines of paying up, he isn't picking up my phone. I have screenshot of paytm and WhatsApp chats.

HIi have read your query and i think if you send recovery notice to friend then he will pay your money if he will not pay your money then you may be filed recovery suit ,or filed civil recovery suit.

you will file section-9 in HINDU marriage act which is know as Restitution of conjugal right because your wife has withdrawn from you without reasonable excuse , you may filed a petition U/S 9 in HMA in family court
