Q: quitting job in a pvt bank where notice period is one month

my son has joined a pvt bank in haryana abt 2 months ago now he has put his resignation on 13 nov as the city and job not suitting him working hours are of 12: hours bank refuses to relocate him near our hone town which we requested only fir few days can we quit before one month onhealth grounds and wat can be the penalties for not completing notice period

Dear Querist,The employment is a contract between two parties (Employer and Employee) and governed by the terms of the employment letter. In the instant matter where your son does not wish to continue with his employer, he has to to satisfy the notice period terms. It is pertinent to note that employer if satisfy may waive the notice period conditions but it is his desecration. Hope this satisfies your query.



Q: Can I quit job without completing notice period on medical grounds

I'm stuck with a bad company with very long notice period (more than 2 months) I have checked with internal resources and come to know that company not co-operating with anyone on early relieving even when we ready to buy out notice period. Because of long notice period i have already lost many good job offers. Now the last option I left with to quit on medical ground asap to grab the new offer. what could be the good options to quit on medical ground legally without getting into any trouble.

In any situation the best option to quit the job is to 'quit on a good note'. However, in case of adverse conditions, you may send your resignation letter either by email or registered post (Ensure you obtain acknowledgement) with the options either serve the notice period or to pay the notice pay. If you go on medical leave and join other organization without reliving by your current employer, may be treated as breach of contract as defined under Indian Contract Act, 1962 and thus your employer may take you to court for compensation. The best way is to send the resignation by registered AD post wherein you can clearly mention whether you would serve the notice period or pay the notice pay.Hope this clarifies.
