Q: Enquiry about the Legal Hiership of a died person from Muslim communit

A person(male) has some property. He is from Muslim community. He has a wife and daughters(no sons). His parents already died. He has two brothers and two sisters. They all have sons and daughters. These two brothers died while this person alive. Two sisters are still alive. Now this person died. Then who all will be the legal hiers of the abovesaid person's property?

Advocate P Venu answered
You have not disclosed the number of daughters. To my knowledge, the wife gets 1/8th share, the daughters 2/3rd and remaining goes to the sisters. The children of the deceased brothers have no entitlement.

Q: Legal procedure to seperate from parents as an adult?

I'm 20 female. Family is mentally and physically abusive because I am not agreeing to get married within 1 year. They are threatening to lock me down at home and then forcefully marry to some guy. I am a chartered accountant and planning to work in different city away from family. But father has political connections so he'll try to bring me back using emotional blackmail and physical harm. After 3 years I have come to conclusion that legally seperating from family forever is the best and safest option. So how do I legally seperate from both my parents? Please tell me the detailed procedure.

Advocate P Venu answered
As an adult, you can choose life of your own. That requires no legal procedure. In case of physical or psychological violence, there are specific provisions under the Indian Penal Code and other laws, which you can rely on as and when necessary.

Q: EWS reservation doubt in total area of residential plot

I am a candidate appearing for JEE 2023. I am having doubts in EWS reseervation deatils. I am looking for ews certificate for national purposes . My Family have an agricultural plot of 3.5 acres. But our house(900sq.feet) is located inside this area. We are from village. Village officer are saying that the total area of the house plot should be less than 200sq.yards. So they are denying the certificate. So is their any chance for me to get this reservation if i go to another authority? Please help me sir...

Advocate P Venu answered
1 square yard is 9 square feet. 200 square yards is 1800 square feet! That is, your house is only of 100 square yards. The village official is not knowing the basic facts. If he is adamant, take up the issue with the higher authorities.

you have the option rather the freedom not to consent to mutual divorce. However, it should not be a confused approach. You need to take steps to file petition for Restitution of Conjugal Rights as well to secure maintainence.

Q: Duration of counseling and mediation

Please tell me the duration between counselings and mediations in contested divorce and how many counselings and mediations are there??? And when the trial starts???
