Questions Answered by Advocate Nitin Kant Ahluwalia

Q: What is the procedure to divide a land among brothers

my father are 4 brothers, we are living outside from last 30yr from our village. Now when we are saying to partition of our land then those are agree but they are offering us to take which is backside of the road and have least value, and they want front side. this is common account number. and this land already transferred to all 4 after our grandfather passed. How can we do in this case legally? Please help..

Advocate Nitin Kant Ahluwalia answered
You have to file a partition suit in the concerned court along with all the facts. No one can be deprived of his right to property and equality. In your case though all the members of your family are ready for partition but mere equal measurement of the land for the purpose of division is not sufficient as the value of the property is to be calculated.

Q: false physical abusive allegation in office by girlfriend

Hi I am working with an MNC.My girlfriend also workss in the same office. I caught my girlfriend having an another affair and had a heated argument in office. Next day my Girlfriend filed a false physical abuse case against me.HR dept marked an email to me saying that I should not come to office till the investigation goes on. Till now they have not told the policy or accuser's name. I have documents-chats, pic showing that the girl was in relationship. I fear that I will be terminated. My question is there anyway that I will get my experience. Should I fight or its gone case?

Advocate Nitin Kant Ahluwalia answered
You must fight dear as you ex girlfriend has also initiated a false complaint against you. If you don't take action then you may be discontinued from the job and also may face another legal hardships. It would be better to take stay from the court for your job and filing a complaint against her in relevant sections to get rid of this false allegations made by her.The most important thing not to do from your side is DO NOT SHARE ANY PHOTOS/VIDEOS/RECORDINGS with anyone without legal consultation.
