Questions Answered by Advocate Nilesh Kumar

Q: Reply to a memo on breach of patient privacy

I have posted pictures of my patients getting treated with damaged equipments in our hospital union what's app group to bring to the notice of concerned authorities and the equipments repaired..now the authorities issued a memo for breach of patients privacy ...will this affect my future and how can I reply for this memo

Advocate Nilesh Kumar answered
Obviously there is a violation of Right to Privacy of the patients. But Right to Privacy is a right of the patients concerned and not the hospital as such. So a violation of this right can be claimed only by the patients and not the hospital. But the hospital can take action if you are in any way in breach of your employment contract, but not for violation right to privacy. For detailed opinion kindly send me the memo.

Q: Property division among 2 brothers and 5 sisters

We are 2 brothers & 5 sisters & muslim. There is some land in our father's village in UP. As per land records we two brothers name is written as "Khatedar ka naam" and our fathers name is written as "Sanrakshak ka naam" as it shows land details in hindi. Father expired in 1999. No "Will" from father. Now we have below few queries : 1. whose right is on this land? Only two brothers or Will Sisters also have share? 2. If sisters have share so how much share in percentage will they have ? 3. To sell land, sisters consent will be required?

Advocate Nilesh Kumar answered
Only the two brothers will have right in the property. The sisters will not be having any right. The two brothers can send the said property to whomsoever they want to sell. No percentage to sisters will arise and no share to them. Hence there consent is also not required.
