Q: Husband forcing for mutual divorce what can i do to protect myself

my husband moved from bangalore to gurgaon , i ve my house in mumbai , we had few fights and we are newly wedded last year , now on instigation from family he is not sharing with me where he is putting up in gurgaon thereby not allowing me to stay with him , he is also coercing me for mutual consent divorce , i wanted to know what can i do in this case to protect myself

Choice is yours. Everything depends upon your capacity, determination. Either you can go for mutual consent or you can fight. If you decide to go for mutual consent divorce and if it is ok with you then ask for a permanent compensation. or else you can file domestic violence case plus 498a case.



Q: travel abroad for holiday trip when DV 498a case pending

my wife has filed a domestic violence case against me. there is also a pending 498a case too. I have got AB and also regular bail and charge sheet is submitted and charge is yet to be framed. The DV case is running and i am contesting both the cases. there is no condition or restrain order to go abroad in 498a or DV case. Can I go abroad as a tourist for short term like 7 to 10 days. Will it weaken my case? By the way, the case is false and since my beloved wife is super greedy , she has filed these cases for free funds, as it appears on the face value of the case. in DV case, she has applied to take my passport into custody, but nothing of that sort happened as i am contesting the case and my lawyer is appearing on the dates. please suggest !

you are at liberty to move out if the court has not granted any restraint order. If your passport is seized by the police even then you can travel abroad ofcourse with the permission of the court. In that case you need to make application before the respective court and the court will grant such order in your favour.



Q: Father in law harassing mentally what action can i take for protection

Got married in 2014. I'm living with my husband and father in law. After some time Gradually things started to change. Starting with my father in law & sisters in law cursing my family. Then they started cursing, abusing & mentally harassing me. I have been blamed for not taking care of father in law & doing jadu toona (All of it is untrue). Toady when i am trying to maintain a distance & mind my own business at home my father in law finds reasons to mentally torture me & my husband. On top of it I have also been blamed for wanting a share in property (Which is not true. I dont care about property. I'M working. Can afford to survive on my own). Initially i used to cry listening to all the false alligations but now i react (ie. shout & reply. No bad words). So Father in law has also gone to the lawyer to file a complaint against me & my husband for not taking care of him (Don't know if he has filed a complaint or no) . My question is should i file a complaint against iin laws

you can file a 498A case against your FAL and Sister in law . Also you can file Domestic violence case against your FAL and Sister in law. It seems your husband is with you. There is something beyond the allegations as there must be property issue involves. Your sister in law is probably interested in grabbing the property of her father.
