Q: Uncle not wiling to divide property as per Will of grandfather

registered will of grandpa has given2 nos of plots share of property to my father which has a plot in between in name of dead uncle who has no successor .we want to sell our both plots property along with half share of dead uncles property,third uncles family not coopoerating for dividation of property as per will. what to do so that w get our share in our name and can sell it

Please mention the property description example which state you belong from. However if it is registered will, you immediately become the beneficary of your respective plots and can execute a sale deed.



Q: Father died house transferred to the mother now she want to sell it

My father died in 2009, the ownership of his house (flat) was transfered to my mother's name in December 2015, she is in process of finalizing the sale and I am homeless because she is staying with her family and tenants have already occupied my father's house is there anything that I can do legally as I will be homeless?

She is the legal owner of her flat. You have not mentioned about your siblings and other family details. However she can at the best part with the consideration amount towards you if she wills to. Hopefully your mother has entered a Leave and License agreement with the tenants in which case she has to give them a one month notice to evict.
