Q: NTC certificate duration

Hi, My car was stolen in november 2016.I have filed FIR and all necessary documents with insurance company .they said they require Non traveable certificate to close the claim.I went to police for the same and they said they require 1 year for NTC as amount is more than 50,000.But in that period my policy will expire.What should I do in this case

Hi there is no time limitation to Police Authority to give Non Traceable Certificate. However, it is to be noted that it is not an essential document to process your insurance claim as per your insurance contract. Therefore I suggest you to approach insurance ombudsman immediately. Your claim will be settled in 1 or 2 months for sure.



Q: Airline didnt inform about Transit Visa Requirement, had to buy ticket

I & my wife were scheduled to travel to New Zealand for our Honeymoon on 2nd week of Feb, 2017 by AirAsia Flight(Chennai to Auckland). This flight makes a 60 mins stop at Gold Coast where we didn't need to change the flight, but still then the Airline did not provide us any clarity that we would need Australian transit visa for the same. This resulted in us not being allowed to board the flight & alternatively we had to buy on-the-counter alternate tickets of different airline for our onward journey (costing us 1.2 lacs) to New Zealand. We are already under a lot of financial & mental distress due to this mishap throwing our entire honeymoon experience & financial saving for a toss. We demand a refund for our onward ticket, alternative ticket cost that we had to buy, Australian visa fee & compensation for the mental stress & agony we had to go through.

Hi need to check whether Airline is required to inform about the requirement of transit visa. If at all if we can establish the fact that the airline is bound to inform the passengers about the transit visa then we can file consumer case and get the compensation with reasonable interest and also compensation towards mental agony and harassment.



Q: How to sue the hospital for bad services and negligence

Bad service provided by hospital and also negligence and wrongfully entered info on my sons bc . And we are after bbmp in getting it done . How can we sue the hospital?

Yes we can sue Hospitals on the ground of negligence. However, suggest you that we need to have sufficient evidence to prove that the Hospital rendered bad service and also what negligent act that they have committed.



Q: False promises made by country club about offers, how to recover money

Hi , I am from Bangalore, I have become the member of country club on 19th June 2016 as they called me and my wife and promised a lot. Now they are stating that many of the offerings they have specified are not valid and I have not even received the club cards. I have paid 1.15 lakh for this purpose. Could some one help me out in how could I get my money refunded back. Thanks so much.

Yes of course you can get back your money if you are able to establish the fact that the country club hasbfailed to fulfill all the assurances and promises made at the time of taking membership from them. Suggest you to approach consumer forum advocate at the earliest.



Q: Clarification on filing appeal in District consumer forum for refund

Hello, Case filed on: Sony, for electronic product worth rs 39000. District forum passed an order: "The complaint filed by the complainant U/s. 12 of the Consumer Protection Act, 1986 is allowed in part. Ops 1 & 3 are directed to pay a sum of Rs 20,000 to the complainant together with litigation cost of Rs 8000." My mobile is still with the service center and probably this point was not highlighted well when I represented my case and the documents submitted might have been overlooked. I would like to contest it in District forum to get a full refund. Can I collect the cheque from Sony now as per State Consumer Forum order and still appeal at District Consumer Forum or should I not take the cheque? Could you please suggest a best way to proceed?

Hi, you can collect the cheque as per the District Forum Order. Subsequently you have the right to prefer appeal before the State Commission for remaining claim. However, limitation to file appeal is only 30 days from the date of order. You better file revision petition immediately as the limitation for filing revision is 90 days from the date of order.
