Q: Wanted to marry other girl under muslim law, parents creating problem

I married have 2 kids . Married for 4 years. I shifted from chennai to salem 2 years back and. I fell in love with a neighbour girl 6 months back. We became very close initially and had physical relationship consensualy. I want to get married to her. She is 17 years old. I can wait for 2 to 3 years for her to complete studies. Her family came to know about us and have threatened to use legal case if i persue her hereafter. I am a muslim. My wife has given her consent. They have got her engaged to some other guy. She says she will come with me. Shes 17 years old she is christian and i dont want her to convert. Advice pls.

Even though with the consent of your 1st wife you could not marry a minor girl. it's an offense.you should wait upto her age of 18. If you initiate any steps to marry her, leads to criminal action against you by her parents. Hence, be patient it's safe to you. There is no way legally.

Q: Can a Hindu girl and Muslim boy get married under Special marriage act

Sir,whether a Hindu girl and Muslim can do register marriage because both the families are not accepting for the marriage .But we have only limited period of time with one or two months can we complete the formalities.

Sir, yes if you both are major it is possible under special marriage act. If you both possess the required original records for age proof and address proof, We could complete the entire formalities within two months from the date of initiation of registration process before the concerned Registrar office.

Q: Muslim wife living separately.How to convince her to stay with me?

Dear Sir, I have been married for 4 years and have a daughter aged 2 years. For the past 6 months, we are living separately. I am in my house (with parents) & she in her house (with parents). She refuses to come and live with me and we didn't had any communication also. Her parents has changed her mind not to live with me (I think so). Through third persons we contacted them but they refuse to say anything. Is there any thing i can do legally so that i can call my wife to live with me.

Dear sir, Under mohammedan Law a Suit should be filed against your wife for Restitution of Conjugal Rights, If there is any Marriage Contact between you and your wife, based on the same we could approach by way of specific performance of the terms of the marriage contract. Only way through court of law to live with your wife is as said above. Thanks

Q: Husband wants divorce but wife is denying. What can be done ?

I got married in April last year _ From the day one there is no love and affection between us. Apart from this we never had intercourse till date.I am totally frustrated after long conversation etc... and told her we will get divorce mutually. She is not agreeing to divorce and I am fed up becoz my pressure is builting up day by day - She is not even taking care of me too... Is there anyway to get divorced ? ... we have seen some physiatrist still things doesn't work

Yes you could get separation by saying null and void marriage before the appropriate court because your matrimonial period is seems to be within one year, you are advised to obtain medical certificate of you and your wife regarding non intercourse for getting judicial separation.
