Questions Answered by Advocate Konakanchi Srinivasa Rao

Q: Lok Ayukta rejects a corruption case despite valid proof. What to do

Dear Sir/Madam, One of my friends has recently filed a corruption case in the State Lok Ayukta of Andhra Pradesh against four state government officials who have misused their power and favoured a factory management unduly, causing a loss of about Rs.11 lakhs to the state exchequer of Andhra Pradesh. Though he has filed the case duly paying the fee and submitting all the documentary evidence and relevant G.O.s and explanation of the corrupt act of the above officials and has also prayed for investigation, the following is the order of the Lok Ayukta : "I do not see any grounds to take cognizance of this matter. Hence, rejected" We all know that living honestly in this country is very difficult, And, proving corruption in the system and is much more difficult (may be impossible some times). The very purpose of Institution of Lok Ayukta of a State is defeated. What can he do when our judiciary is ignoring and indirectly protecting the corrupt officials?

Advocate Konakanchi Srinivasa Rao answered
As per this query the officials corrupted for RS. 11 lakh by favoring to company management, the lokayuktha rejected your query as there's no ground to take cognigence, if the lokayuktha rejected on the same ground better to appeal.

Q: What can be done anticipatory bail has been rejected

I have been falsely accused of committing a cheating crime under sec 420. I'm 70 years old & dependent wife in home, no children. I don't know much of legal system, I applied for anticipatory bail & given legal aid from court as I didn't have one. Sadly anticipatory bail is dismissed with Nature of Disposal: Uncontested--DISMISSED. When I met a lawyer he is saying I have two options now. 1) Apply for bail in magistrate court again. 2) appeal in high court. Lawyer is asking to take decision & visit him. Could you please suggest the better option.

Advocate Konakanchi Srinivasa Rao answered
As per this query the petition is dismissed for as you are uncontested. If you are uncontested, you will file the petition before the magistrate court again or that petition is dismissed on merits, better prefer appeal.

Q: Land Aquisition under 3(A) of National Highways Act 1956

Our land of 324 Sq.Mtrs. along with a building therein is proposed to acquire under above NH act and under RFCT LAR&R Act,2013. Publications were made by Govt. in local news papers on 29.5.2015 & 25.7.2016. Possession was not yet taken. Objections were raised by me on 19.9.2015 itself at the time of enquiry stating that the prevailing Market value of our land is about Rs.20000/- per Sq.yd. and the said objections raised by me were rejected by LAO on 23.11.2015. Award was not yet communicated to me. But it is learnt that award was passed at Rs.1100/- per Sq.yd.(Rs.1315.5 per Sq.Mtr.) as per the basic value at the local sub-registrar office which is very low when compared to the prevailing market value. Now the question is whether to go for a writ in High Court of AP individually by me or as a group with others before communicating the award to us or after taking the award money. What are the expected expences and is there any limitation in this regard.

Advocate Konakanchi Srinivasa Rao answered
As per this query the possession was with you and they paid the compensation as per the GO terms and conditions, if the compensation amount is not sufficient you can approach the hon'ble Court the expected expenses are nominal and for appeal there is limitation.
