Q: Need legal advice on girlfriend's cheating

Me and my girlfriend have 6 years of relationship. I was working in cognizant and lost it now I'm not getting job. she made fake promises that her parents don't treat her well and she will marry me only but now I get to know that she and her parents are involved in that. I gave her 2 phones which she gave to her mother and father And she made me spend more money on movies, parks, temples, hotels etc. Now she don't want me. I suffered a lot I am unable to sleep or eat my health condition spoiled

If you are interested in marry her, you ought not to wait all these 6 yesrs till loosing your position.all the money you spent to her over these 6 years as you spent with her.have you both gave birth to any chaid?it's not mandatory to her to get marry you and it can be enforced by law.It's a nightmare and forget that what happened so far. keep faith on your future and loyalty to your family. regain your strength and re build your career and go ahead.realise your self. don't waste time or money. in such circumstances, no one can succeed the situations against the will of such girl.Alo of is there beyond that girl. don't loose hope on life.there is a bright future ahead and you have to behave as a loyal son of your parents and a responsible brother of your siblings. you are suggested not to take any hastic steps for this stupid incident.Hence, I am recommending you to leave the matter herewith what happened so far for the past 6 years.take a turn towards family and regain your strength and re build your carrier.there is no use in proceeding further legally even you afford huse amounts on lawyers.

Q: Want to apply for Annulment of my marriage

I married on nov 15th 2023, I got married to the Christian,with the Christian traditional,but my marriage was happened by the cruelly slapping by mom's brother and forcefully made me to marry & iam in relationship with someone else,my family was blackmailed me for accepting this marriage, i always considered this marriage as null only more over husband has a relationship too.now i want to apply for annulment of my marriage the mentioned grounds can a Christian applied for the annulment of marria

marriage held in between you and your spouse is a valid one as it happened according to your caste/religious customs in presence of elders. now coming to the issue of the pressures by elders in order to get married the girl which is said to be against your willingness, will be a good ground for dissolution of the marriage.you can demand divorce by issuing a legal notice to her by describing the facts so far taken place in your forcefully happened marriage.you have to prove that putting you into fear and coercion, pressure commited by the so calld elders in your marriage.other wise try to get divorce by mutual consent.

Q: Cheating wife and i want divorce

My wife cheated me. She has been married before and never divorced. She was not told this to me. We have a 5 month old baby now. We got a child through donor eggs due to my wife infertility problem. When I know her first marriage i asks her about first marriage, she goes to her parents house. she didn't show me my child. Can I take legal action for my wife cheating ? And can divorce be obtained? What should I do for my child is with me? I have all the evidence. Please help.

you have to furnish the information to just suggestion.wether the previous marriage of your wife is a valid one or not? what I mean whether the said marriage is taken place among them as per caste customs or not? with the consent of the elders? registered?if her first marriage was performed in a right way, the marriage is with you is a null and void one. the marriage with you is not a valid one and you are not termed as her husband as per law. all the period you spent with her after your marriage is not a wedlock and it's deemed to be like a live in relationship.as long as she is not a divorcee from her previous marriage, the said marriage will remains in force and then the question of 2nd marriage does not arise.when you are not a husband legally, the question of divorce does not arise.Now you can file a petition before court with a prayer for declare the marriage in between you and her is a null and void as she committed fraudulent marriage by concealing the facts.

Q: Father's sister extorting money from us using blackmail

My aunt had given us 16lakhs as loan in 2013 Jan at 30% interest rate. Starting from 2022 she claimed we owed us 3.3 Crores. She started bringing people over and created ruckus. Her son and daughter along with their spouses tried started blackmailing us with suicide notes, messages with abusive language, calling relatives and spreading mis information. Under extreme duress and declining health my father signed an agreement to pay half of it. Still they are harassing us. What to do?

there is no clarity in the rate of interest @30% claiming by your aunt weather it is for one month or for one year or totally? you are all liable to pay what ever you lend from your aunt with a reasonable rate of interest. in case of your aunt and her men insisting you to pay the debt with such abnormal rate of interest, you can lodge a report with police. you can also make a complaint with police as to high handed behaviour and giving pressures causing by your aunt and her men. you can also give a report to police against the execution of the agreement by your father in unfair means under putting pressures. such agreement is not an enforceable.

Q: Lok Adalat settlement payment mode, wife insisting of paying cash

Wife agreed for lok Adalat settlement for Divorce, revoke of 498A, MC and DVC cases in front of judge. Judge put observation and asked do the payment in next lok Adalat date and close the case. But now wife party is not agreeing for DD, Cheque or RTGS payment mode, and insisting on cash mode of payment. Is it safe to pay final settlement via cash ? Should I insist for Demand draft mode. Pls advise.

You should pay the amount to your wife through bank only. Cash transactions of huse amounts are not recommended. we should not entertain such short cuts which is against the guidelines by RBI.you can choose any recommended mode of transfer of huse amount into her account.
