Q: Query related to the recently passed Maternity Benefit Act

Hi, Can you please advice if under the Maternity Benefit Act, maternity leave actually counts from the day of delivery of the baby (including the delivery day), OR from the day I took the maternity leave (which was few days before my baby was born)? In the former case, I am eligible for the 26 weeks leave under the new amendment of the Act and in latter case - I am not.

Advocate Deepak Kumar Verma answered
Dear friend,After new amendment, maternity leave granted for 26weeks from the date of granting leave on your application. Not from the date of birth of the baby.after leave you join your duty immediately. thanks

Q: Two real brothers got married to two real sisters...now 498

We are two real brothers married to two real sisters... Now the younger sister has put a case of 498 and 323 on my brother and parents (not on me). My wife(real elder sister to my brother's wife) also left me and now she has also given statement that my brother and parents were asking dowry from her sister and beating her. I want to understand the legal consequences on:- 1) As both are real sisters naturally both will support each other. Does her statement be considered in court as she was also living in the same house ? 2) If I give my statement as I am also living in same house.. Will it make our case strong? 3) Both are asking us to leave our parents and stay in rented house whereas my wife is asking to leave the city?

Advocate Deepak Kumar Verma answered
The statement of your wife is not a good piece of evidence as she is real sister of victim. However,at the time of evidence you may also give your statement before the court.my advice to you that you will try to compromise in the matter out of Court.

Q: Divorce from in laws family as mother in law is not good

My mother in law is absolute inhuman in nature....she creates fractions between me n my husband verbally via emotional blackmail. We don't even stay with her as my husband has job in US but her continuous rumours against me n my family is making things very difficult to survive. I'm hindu n have 1 son.

Advocate Deepak Kumar Verma answered
Firstly you give the details to your husband and request that what steps you take.you have an option to live with your parental house till your husband not came back or live separately in separate accommodation.
