Q: Filling for maintenance when husband refusing to pay

Hello, I am Indian, live in rishikesh, from north India. The boy is from Australia, he wants me to apply for divorce for mutual but he wants me to apply form india and i did but i have applied for maintenance too and he does not want to give any. he has never taken care of me when it comes to economical and not being loyal and family discriminations and always making me do all the day to day chores paper work. i am not working due to all the pressure of the marriage not being successful so i am in need of help of maintenance and he says confidently that he does not need to come to india and he does not want to pay any maintenance. please advice.

Divorce can be taken even in his absence but special permission has to be sought from court and it is totally court's discretion. Maintenance can be filed only under section 125 Cr.P.C or domestic violence act.

my wife filed false complain against me in mahila help line.help line called me 3times but my wife came one time only.after thai i filed case under section 9 for my wife back.shoul i go help line if they call.what action can be taken by help line although i informed help line about my case.please guide

You should appear before the Help Line and present copy of the petition u/s 9 HMA. The Help Line does not itself take any action. It only recommends proposed action usually to the Police Station concerned.

If that does not appear to resolve things you can file an application before the Protection Officer under the Domestic Violence Act and seek interim financial and residential assistance.You can later or simultaneously file a petition u/s 125 Cr.P.C. asking for maintenance from your husband.
