Q: Where to get Divorce if registered outside India?

Hi We got married in married in 2009 in Australia and it was a court marriage. We went to India in 201 for traditional marriage. We both are permanent resident in Australia. Now I want to get divorce from my wife so which marriage is valid for divorce and where I should file a divorce application. Can I get divorce in Australia? And which marriage is valid for divorce 2009 registered marriage in Australia or 2011 traditional marriage in India. Thanks

In india if you perform marriage in India, you need to get divorce only in India, if you get divorce in Australia, it would not valid in India except some cirumstances in which the divorce outside India where the marrige ceremony performed here, i suggest you to get divorce in India rather than anywhere else



Q: divorced in Australia valid in India or not

Hi I am dual citizen holder of newzealand and india and wife is Indian citizen. After 4 years of marriage I filed for divorce in Australia and my wife received summons from process server and she signed it. After 2 months I won the case and got divorced. Is this divorce valid in India? She living in Australia for over 2 years and working there.

Hi firstly tell us wheather your marriage was solminized in india or in other country, if u married in india than you should have get divorce in india, because there are supreme court judgment which specificaly stated that if marriage is performed in india than it should be disolve in india not in other country

I'm living with my parents because of abusive and harassing nature of my husband and in-laws since October 2014. He has filed a case under section 9 of HMA to defend him. Is it necessary on my part to go to the court on hearings?

No hma cases are civil in nature you dont need to appear ok each and every date you can appear through ur counsel. You have to appear only than when the court directs you or on date of evidence. So u can file othercase against the boy
