Q: Annual performance appraisal withheld since 4 months

I am eligible for Annual Appraisal which was due in October but it was delayed and i was told that It will happen in January but now I am told that it will now happen in March. I want to know what legal action can be taken in this regard and what are my rights in these circumstances.

We can file a suit for mandatory injunction directing them to do your appraisal as per policy/ contractual terms and may also claim damages for any loss occurred to you. Further opinion can be given after perusing your policy regarding your appraisal.



Q: Company not granting leave in emergency situation what action to take

Can a company deny leaves for 3 days to female in case if her child get hospitalised in an emergency situation. She is able to provide all medical and insurance proof, also has enough leave balance. Even in leave policy nothing was mentioned regarding any policy like this. Can u guide what legal action can be taken in this situation

If there is no contractual terms qua your leave in such a situation then you may go ahead upright and let the company takes an action againt you whatever they wish. And we can challenge the same by filing a declaratory suit.
