Q: Need to understand if we are eligible for divorce

Its been 8 months of our marriage, it was love marriage. for last 6 months we have been having some awful fights and we just understood that its not going to work like this, since we both are unable to understand or adjust our ways to deal with each other during a smallest of fights. Its getting worst and worst and now we prefer to live peacefully separately than living like this.

To file divorce petition mutually you must be living separately for one year and also fulfill the term of one year of marriage then you both can file divorce petition mutually under section 13 b of Hindu marriage act and if your spouse is not ready for divorce then you can file under section 13 of Hindu marriage act if you are a Hindu or sikh by religion



Q: Sim bought on our name without our knowledge, what to do

Q: How to recover lent money

Sir, I lent money to someone as he assures me he will give a large interest to me. At the time of borrowing he also give cheque to me to withdraw money and on cheque the date was not written but as i know now the cheque will bounce. Whenever i contact that person he said he will give me money and there is no written agreement between we two

Cheque given to you is his legal liability to pay you its an agreement in itself that he given a Cheque to you so don't worry your money is safe and never give your money to anyone for huge interest bcoz it's illegal in the eye of law. You can file the Cheque in your account after writing the current date and when it bounced back then contact a good lawyer as soon as possible.



Q: Clarification on selling and transfer of ownership of a car

I sold my car 1.5 years back.I signed the stamp paper mentioning that I have sold the car.But now the person is telling that he is not able to transfer the car on his name.What should i do legally to disassociate myself with the car?

Q: Brothers claiming right over house transferred to me by Will

Religion -Hindu. We are ä Joint family. My grandfather wrote ä vasiyat nama of house we are residing in. G.F of house is completely built has two portions - one Portion is resided by 3rd son+his family, 2nd Portion is resided by 4th son+his family. 1st Floor is partially built, has terrace and is resided by 1st son and his family. There is nö other Floor. 2nd son is clearly separated out in vasiyatnama. I am son of 1st son and reside on 1st floor. Grandfather passed away in 07, grandmother in 16. The exact lines of vasiyatnama says "Malikana haq of this House is with me (grandfather) till I am Alive, After my death malikana haq is of my Wife, After Wife malikana haq is of 1st,3rd and 4th son. Both Grandparents lived with and were being looked after by 1st son (My Fäther).Grandmother separately wrote that post her death 1st Floor belongs to 1st son and no Claim can be made by other two sons (signed by her but not legalised) 3rd & 4th son now claim on terrace of 1st Floor, PL. Advise.

Do you got registered the will and get sanctioned the mutation or if in city got the registration in nagar Paris had or nagar palika if such thing is done than you can file civil suit one other thing is it was your grand father's self acquired property than they can't claim according to will
