Q: Dowry Demand Abuse physciak mental done by husband and in laws.

I faced mental and physical harassment by my husband and in-Laws. They keep demanding dowry after marriage also. I filed cases against them in 2019. They come back to me and accept their mistakes. He again did the same things to me. He is absconding to the USA since last year Feb 2020 without letting me know. I came to know after 6 months. All that Compromise was done by him and his family so that he can abscond. Now I have already filed cases against him and his family in 2020.

You should demands the maintenance to your husband. Under Section 12 of Domestic violance and section 125 of Cr.P.C. you can get maintenance and other benefitsto your husband . Please file these petition against your husband.

Q: Separation on ground of extramarital affair

My huseband is having extramarital affair,but he is not accepting it,I have my baby of 7 months,if I ll leave his house without any legal action,how can I claim maintenance from him?

First you should evidence of extra marital affair of your husband. If you have this then you should sui of Divorce against your husband. Second if you have not any evidence then you should lodge a F.I.R. against your husband for demanding of dowry and physical and mental cruelty. This FIR helps you for demanding maintenance to your husband. Under section 125 Cr.P.C. and Under section 12 of Domestic violance you should demands the maintenance to your husband for you and your child

Q: Divorce file case against my wife without any punishment for the case

My wife is harassing me to get my parents arrested for false dawry case. She accepted in front of me that she is cheating me.I don't hv any phone recording of these but only have the audio recording.How can I proceed in this case without getting punished for d crimes I have not committed. She is threatening me to put me and my family in jail.

First, you make audio recording CD only than it will be considered as an evidence.whenever your wife lodge a F.I.R. against you and your family than you should contact to police.Police, will remove the name of your family in the FIR on the basis of that evidence/CD.Police may consider this FIR as a false FIR.If police doesn't consider it as a false FIR than you will benifit in Anticipatory bill.

Q: My father is threatening me to take back my divorce case

I am 25 years old and a mother of 16months old. Me and my husband agreed for mutual consent divorce and i decided to leave my in laws house as well as my father's house because my father is so very dominat from beginning. He never let me take my decisions he is always full of anger and wants me to behave like a puppet even if I am an adult but there is no chance to continue this loveless marriage for me. I decided to stay separate with my kid but my father came here and created scene ,he threatened me , I asked police for help but my father used his power and money to influence the cops , so police instead of helping me adviced me to go back with my father. Iam not committing any crime , freedom is everyone's fundamental right, I just want to live my life on my own terms want to take care of my kid on my own, I don't want to stay under dominance anymore. Please help me what legal measures can i take against my father which will prohibit him to interfere in my life, I am an adult .

First, you should suit against your father in Local civil court about not disturbing you.Second, through high court you can demand Police Security against your father.Third, You should take mutual consent divorce to your husband Also do decide to take care of your Child in divorce.
