Want to get legal heir cert. I am a NRI and my sisters and brother are in chennai. My parents are no more. Our parents property is in chennai and we want to dispose off this for which we need to apply for the legal heir cert. What is the fees, How long does it take and what are the documents needed Are there any agents in chennai whom I can trust to get it as early as possible,

Generally, people go in for Legal Heir certificate issued by Taluk office. The Revenue Department officials get declaration and affidavit from the applicant, from other legal heirs and issue the certificate. It has no legal sanctity. But practically it is convenient and invariably people rely upon this certificate. No fee is prescribed. We have to apply and closely follow it up.



Q: Filing a case in NCRDC against the builder for compensation for delay

We about 10-15 owners of a Housing project in chennai, willing to file a case in NCRDC against the builder for delay compensation. we would like to know whether we can directly file a consumer case as group to NCRDC (Without forming an owners association). The individual property value ranging from 98 lacs to 1.2 crores.

Each aggrieved person has to file individual Petition claiming compensation based on his/ her individual agreement with the promoter. Cause of action is different. Therefore Joint Petition will not lie.



Q: Payments not being done by the Client what to do.

We are a HR recruitment firm and have been working with various corporates. One of our customer, who is based out of Chennai has not paid our 7 Invoices and the delay has been of more than 4 months now from agreed timelines in contract. They have stopped responding to reminders also. Can you advise what action can be taken against this company? We have a legal contract signed with the company.

For recovering the amount due to you, you have to file a civil suit before competent court of law. If the defaulter is a Company and if the company has acknowledged the debt to you, you can go in for winding up proceedings for inability to pay debt.

Sir, I have received a mail ( Lawyer Notice) from Law firm to attend the meeting at Bank on 21st Oct'16. Kindly advise how to handle it.

Q: BSNL not providing broadband connection

I am requesting BSNL connection for more than 5 years still they are saying not feasible, but next to my house they have provided connections for Schools and Church due to big reference which i don't have. I need Internet for my career and kids education. I can't shift house also. No other ISP is available in my area (Thirumullaivoyal, Thendral Nagar West) Is it possible to go court and get justice. I have complaint to the grievance level and got letter from GM saying not feasible. Please help

When BSNL says it is not feasible, it must be on some sound reason. In the grievance Cell, did they conduct enquiry and pass orders on merits? If there is flaw in the orders, you may file writ petition. Court will call for records and pass orders.
